The City Council on April 8 approved a temporary easement agreement with Old Ranch Country Club. According to the staff report, the easement is needed as part of the Lampson Avenue Bike Lane Gap Closure Project. This was a Consent Calendar item. Consent items are approved collectively, without discussion, unless pulled for individual consideration. This item was not pulled.
The project was scheduled to begin Monday, April 8, several hours before the council meeting began.
“In compliance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (the “Uniform Act”), a Right-of-Way Certification is required to document property interests within the Project’s limits,” according to the staff report by Public Works Director Iris Lee.
“On October 24, 2022, the City Council adopted Resolution 7342 approving and accepting the Project-necessitated Temporary Construction Easement (‘Original TCE Agreement’) at the northeast corner of Lampson Avenue approaching Seal Beach Boulevard,” Lee wrote.
“This property is owned by Old Ranch Country Club, LLC. The Original TCE Agreement was recorded at the Orange County Clerk-Recorder as Doc. No. 2022000353598 on November 3, 2022,” Lee wrote.
However, the agreement expired on Feb. 1, 2024, according to Lee. This happened while the Federal funding was being processed.
“As such, staff recommends that the City Council approve the execution and recordation of a new Temporary Construction Agreement (“TCE Agreement”) with an expiration date of April 8, 2025,” Lee wrote.
“The Project construction Notice-to-Proceed has been issued. Construction mobilization is scheduled for early April 2024,” Lee wrote.
