FOR IMMEDIATE RELEASE
Seal Beach, CA – On July 29, 2015, at 5:43 pm, Seal Beach Police officers detained five suspects for petty theft and felony aggravated assaulted.  The investigation revealed a 27-year-old Hispanic male named Osiris Gabriel Jimenez out of La Puente, CA, attempted to steal a bicycle from the front yard of a residence located in the 100 Block of 6thStreet, Seal Beach.  The victim and victim’s brother (both Seal Beach residents) observed the theft occurring, called 911, and began chasing the suspect.  The suspect then dropped the bike and continued running northbound onto 6thStreet.
Two witnesses in this case observed this; therefore, they intervened and tackled Jimenez to the ground.  While the witnesses were attempting to restrain Jimenez, four of Jimenez’s friends/relatives drove towards him in a pickup truck to assist.  One of the four friends, a 20 year old Hispanic male out of Azusa, CA, named Stephen Benitez-Toscano exited the truck and bit one of the witnesses in the stomach area.
At this time, police arrived and controlled the incident.  Two of the four subjects in the pickup truck were not charged with any crime.  However, one of the other suspect’s friends, a 24 year old Hispanic male out of Covina, CA, named Nicholas Joshua Franco was found to be in possession of Xanax pills without a prescription.
 The individuals arrested and their charges are listed below:
Nicholas Joshua Franco – cited and released for H&S 11375(b)(2)
Stephen Benitez-Toscano – arrested and booked for CPC 245(a)(4) and CPC 203
Osiris Gabriel Jimenez – cited and released for CPC 488 & CPC 240
There was no surveillance video of this incident and no follow-up witnesses are needed; therefore, no booking photos will be released.
