A judge on Wednesday, May 2, dismissed the cocaine possession charge against a College Park East man who remains accused of attacking his mother with a sword.
Defendant Andrew Baoan Nguyen, 21, was in court for his preliminary hearing.
The case apparently ended with him being “held to answer,” which means he will be going to trial on three charges stemming from reportedly threating his mother with a 5-foot-long samurai sword on April 16. He is scheduled to be arraigned on May 17, a procedure that usually follows a preliminary hearing when a criminal case is going to trial.
Nguyen is now charged with making criminal threats, assault with a deadly weapon other than a firearm and a sentencing “enhancement” of using a dangerous weapon.
Authorities say Nguyen attacked his mother with a sword on April 16 during a family argument. She ran out of the house and down the street. She flagged down a passing Seal Beach Police Department patrol car.
According to the SBPD, Nguyen was not home when police arrived. An Orange County Sheriff’s Department unit spied his car on the 405 Freeway at about 7 p.m. that night. He was followed back to his Elder Avenue home, where he was arrested by Seal Beach PD.
At the time, police said he was under the influence of cocaine and in possession of cocaine.
According to the Orange County Superior Court website, Nguyen is still in custody. However, according to the Sheriff’s Department website, Nguyen—who was booked under the surname Nuguyenphuc—was released on bail at 2:38 p.m., Saturday, May 5.
