Crime Log: Seal Beach fraud sentencing hearing continued to October

The real estate fraud sentencing hearing for John Wesley Martynec, 36, has been continued to Oct. 10, according to the Orange County Superior Court website.

Martynec’s sentencing hearing was held Friday, June 8, according to the courthouse website. However, the hearing was scheduled to continue on Oct. 26.

Martynec remains free on $150,000 bail.

In March, the Long Beach resident pleaded guilty Friday, March 16, to stealing $302,000 from real estate investors by promising to buy and re-sell foreclosed homes for a profit—houses that were never bought.

Martynec , pleaded guilty to two felony counts of grand theft, one felony count of untrue statements in connection with a purchase or sale of securities and the use of a scheme to defraud, one felony count of financial exploitation of an elder, and a sentencing enhancement for property loss exceeding $200,000.

According to the Orange County District Attorney’s Office, Martynec faces a maximum sentence of three years in state prison at his sentencing hearing, which has been scheduled for June 8, at 9 a.m. in Department C-5, Central Justice Center, Santa Ana.

Martynec was originally charged with 33 felony counts, including eight counts of grand theft.

The Seal Beach Police Department arrested Martynec in August 2011.

According to the DA’s Office, Martynec took money from investors to buy and sell foreclosed houses.

However Martynec never bought any houses.

Prosecutors say that between August 2009 and August 2010, Martynec stole $302,000 from four investors, Patrick L. and Howard H., both 78, Howard H.’s son Michael H., and Chris L. Martynec told these investors that he had 10 years of experience in buying and flipping foreclosed homes for a profit.

Indecent Exposure—3:08 a.m.—Pacific Coast Highway—The caller said a man in the liquor area of the business had no clothes under his jacket.

Police unit 207 released the man to his brother.

Vehicle Burglary—10:12 a.m.—12th Street—The crime apparently occurred between 3 and 9 a.m. Point of entry: smashed front driver’s side window. Loss: a laptop valued at $900. No suspect information. Report taken.

Found Property—1:16 p.m.—Ocean Avenue—The caller was with a lifeguard at the First Street Jetting. The caller found a Smith & Wesson firearm. The log did not describe the weapon.

Municipal Code Violation—1:20 p.m.—B Row, Surfside Colony—Incident.

Tuesday, May 29

Drunk—2:29 a.m.—Pacific Coast Highway—The caller said a drunk man in his 70s was getting in a car. Police unit 207 escorted the man back to his home in Long Beach.

Counseling—4:27 a.m.—Pacific Coast Highway—The caller said the same drunk individual in the 2:29 a.m. incident left his car in the parking lot. That individual phoned the caller’s business and threatened to blow up Seal Beach.

The store manager did not desire a report.

Graffiti/Vandalism—7:46 a.m.—First Street—The caller reported writing in black pen in the men’s bathroom. Report taken.

Hazard—1:12 a.m.—Seal Beach Boulevard and Westminster Avenue—The caller reported large debris in the roadway. Cars were swerving to avoid the debris. The log did not describe the debris. The debris was removed from the road.

Wednesday, May 30

Vandalism Report—10:21 a.m.—Seal Beach Boulevard—The caller reported damaged plants at the business.

The incident apparently occurred at 4:55 p.m., Tuesday, May 29. The caller said the individual responsible for the damage was an unhappy former customer. The caller wanted the individual to apologize. Police advised the caller to contact them if the individual returned. The caller did not desire a report.

Traffic Collision, Vehicle Versus Pedestrian—3:13 p.m.—Seal Beach Boulevard and St. Cloud Drive—the collision apparently occurred between 6:30 and 6:45 a.m. The caller’s son was reportedly hit by a car.

The other party did exchange information and did talk to the caller. However, the caller now requested a report. Report taken.

Vehicle Burglary—6:16 a.m.—Lampson Avenue—The crime occurred between 2 p.m., Tuesday, May 29, and the time of the call to the police. Point of entry: a smashed front passenger side window. Loss: unknown.

A second victim vehicle was identified at 6:33 a.m. with a smashed rear passenger window. No suspect information. Report taken.

Traffic Hazard—8:27 p.m.—Electric Avenue—The caller said a man on an electric bike was going westbound on Electric in the eastbound lane.

The caller was concerned because it was getting dark and it was hard to see the bicyclist.

Thursday, May 31

Auto Theft Report—7:12 a.m.—16th Street—The caller said the car was stolen between 6 p.m., Wednesday, May 30, and the time of the call to police. Report taken.

Petty Theft Report—2:12 p.m.—Seal Beach Boulevard—The crime apparently occurred between noon and 1:45 p.m.

The caller said a man and a woman came into the store with a baby stroller and took several packages of power sources. Report taken.

Friday, June 1

Patrol Check—7:41 a.m.—Arbor Park—Police unit 106 contacted a woman with two dogs off leash in the park. She was told she was violating the Municipal Code. She said she had no idea about the park rules. The officer advised her to read the six signs posted in and around the park.

Disturbance—8:50 a.m.—Pacific Coast Highway and Seal Beach Boulevard—The caller said an individual who the caller described as a transient was draped in a blanket and blowing on papers that were burning.

The officer in unit 107 advised the individual against burning papers.

Suspicious Person—11:26 a.m.—13th Street—The caller reported an individual going up and down the street on a skateboard. The caller said the skateboarder was unknown to the area.

The caller said a driver pulled up to 13th Street and the skateboarder approached the driver. The skateboarder then took what appeared to be some sort of document from the driver.

Saturday, June 2

Suspicious Person—6:31 a.m.—First Street—The caller said three men were trying different doors to apartments. The caller didn’t think the three men lived there.

Police unit 107 found a maintenance crew and determined no further police services were necessary .

No Crime—7 a.m.—Fifth Street—The caller said the front window to the residence was shattered between 5:30 and 9:15 p.m., Friday, June 1.

Police unit 107 found a double glass door. Only the inner panel of glass was broken. There were no marks on the outer panel. There was no sign the damage was caused by someone outside the house.

The officer concluded there was no evidence of a crime. Log entry.

Police Information—11:55 a.m.—Catalina Avenue—The caller’s vehicle was egged overnight. Log entry.

Extra Patrol Checks Requested—5:50 a.m.—Fathom Avenue—The caller’s residence was egged the night before.

The caller requested extra patrol checks overnight. Beat unit advised.

Sunday, June 3

Prowler—1:59 a.m.—11th Street—The caller heard someone walking on the south side of the house.

Police units 241 and 206 checked the front yard. Unit 207 checked the rear yard. Officers determined the yards were clear. Police unit 207 tried to contact three individuals at the corner. The officers determined no futher police services were necessary.

Found Property—2:22 a.m.—Ocean Avenue and 8th Street—Police unit 241 found a bicycle and temporarily secured it.

Petty Theft Report—7:15 p.m.—Seal Beach Boulevard—The caller reported the theft of a black frame six-gear bike.

The caller was inside a business for five minutes while the bike was stolen.

The bike was locked before the caller went inside. The bike was valued at $350.

No suspect information. Report taken.

In Leisure World

 

Monday, May 28

Suspicious Person—5:39 p.m.—Sunningdale Road, Mutual 14—The caller said a man parked in a pickup truck was working there.

The caller said Leisure World Security had contacted them earlier and told them to leave. However, the man and the pickup truck were still there.

Police contacted Leisure World Security. They had no record of contacting anyone there that day. It turned out the individual in question was a caregiver who was no longer wanted there. If the caller had another complaint, she could contact her Mutual 14 board. No further police services were necssary.

Wednesday, May 30

Welfare Check—11:28 p.m.—McKinney Way, Mutual 15—The caller received a medical alarm from an individual.

However, it turned out the alarm was triggered accidentally.

In Los Alamitos

Sunday, May 27

Disturbance—6:42 p.m.—Cherry Street—The caller said he was trying to take his girlfriend home and that she refused to get out of the car.

The caller did not know what street he was on and could only provide numbers. The caller disconnected and two attempts to call the citizen back went straight to voicemail.

Drugs—6:45 p.m.—Farquhar Avenue—The caller said that he found marijuana in a television he had bought off of Craig’s List and that the person who had delivered the TV was in the area looking for the marijuana.

The individual in question was with another individual who drives a silver Chevy Silverado. The caller said if the suspects were gone upon the officer’s arrival, it was OK to contact him.

The subjects were gone upon arrival.

Wednesday, May 30

Suspicious Vehicle—2:08 p.m.—Paseo Bonita—The caller reported a suspicious vehicle in the driveway of a house he owns.

The house is vacant and for sale, so no one should be there. A neighbor called to inform him of a gray truck parked in the driveway.

The caller had a contractor working on the house, but the contractor drove a white truck.

A patrol unit found a man in the backyard.

That man was subsequently arrested for prowling.

Wednesday, May 30

Malicious Mischief—6:03 p.m.—Farquhar Avenue—The caller said a group of juveniles with markers was in the area.

One of the female juveniles appeared to be writing under the red tube slide.

Patrol found 10 juveniles in the playground area and had them clean up their mess. All the juveniles were released to their parents.

Thursday, May 31

Patrol Check—4:43 p.m.—Farquhar Avenue—The caller said a woman in her 50s in a wheelchair had her dog off leash and was playing ball with it.

The caller asked the woman to put her dog on a leash and she promptly told the caller off using vulgar language. The caller asked a patrol check for the woman and her dog.
